These terms are the agreement between you and Trine Point LLC for using SweatCut: the Mac app, SweatCut Cloud and sweatcut.com. By creating an account or using SweatCut, you agree to them.
These terms
Trine Point LLC, a company in the United States, makes SweatCut. In these terms, "we" means Trine Point LLC and "you" means the person using SweatCut.
Lemon Squeezy sells SweatCut's tiers as the merchant of record. You pay Lemon Squeezy, and its buyer terms apply to the payment as well as these.
How we handle your data is in our Privacy Policy.
You must be at least 13 to use SweatCut. If you're not yet an adult where you live, a parent or guardian has to agree to these terms for you.
Your account
You sign in with your email address and a code we email to it. Anyone who can read that email can sign in as you, so keep it secure.
An account is for one person. Don't share it. You can sign in on any Mac you use.
You can stop using SweatCut at any time. To close your account, email hello@sweatcut.com from its address. What we delete, and what we keep, is in the Privacy Policy.
The free trial
Each account gets one free trial, and so does each Mac. Once a Mac has had a free trial, no other account gets one on it, even after the first account is closed. What the trial includes is on the pricing page.
The trial ends when you subscribe to any tier. Credits left from it stay on your account.
Paying for a tier
You pay for a tier in advance, a month at a time, or a year at a time if you pay yearly. The prices are on the pricing page, and Lemon Squeezy adds any sales tax or VAT where you live.
Your tier renews on its own at the end of each period, and Lemon Squeezy charges the same card, until you cancel.
If a payment fails, Lemon Squeezy tries again for a while, and your tier stays on meanwhile. If it keeps failing, your tier ends.
We can change our prices at any time, without notice. You're charged the price in effect on the day of the charge.
If a price is wrong because of a mistake, we can correct it, and cancel any purchase made at the wrong price.
Sometimes we offer discounts, special prices or referral offers. An offer can come with its own terms, which we'll show with it. We can change or end an offer at any time, without notice.
The card you pay with must be yours, or one you're allowed to use, the details you give must be correct, and you and your bank have to honour the charges. If not, we can end your tier, close your account and stop you subscribing again.
Cancelling and refunds
You can cancel any time in SweatCut, in Settings › General › Manage subscription. You won't be charged again, and your tier stays on until the end of the period you've paid for.
Payments aren't refunded, including for part of a period, or for credits and exports you didn't use. If something has gone wrong, email us and we'll look at it. If the law where you live says you're owed a refund, you still get it.
What your tier includes
Each tier gives you a number of exports a month, a longest video you can export, and a number of credits a month. The numbers are on the pricing page.
- The longest video counts the finished video, after your cuts, not the footage you filmed.
- The export count starts again on the 1st of each month (UTC). An export counts once its file is saved, so a failed or cancelled export doesn't count.
- Your tier's credits arrive each month and last until the next month's arrive. Credits you don't use don't carry over.
- If you move up a tier partway through a month, you get the extra credits straight away. If you move down, you keep the credits you already have until the month ends.
- Credits have no cash value, and can't be sold or moved to another account.
SweatCut needs to reach the internet at least once every 14 days to keep your tier's features on. After that, importing footage, exporting and auto-edit wait until you're back online. Your workouts still open, and you can keep editing them.
When your tier ends, importing footage, exporting and auto-edit stop. Auto-edit stays open while you have credits left. Your workouts still open and you can keep editing them, and nothing on your Mac is deleted.
Auto-edit
Auto-edit makes a draft for you to check. Check it before you export: we don't promise the draft is right.
A run costs credits, and SweatCut shows how many before you start it. Once Cancel greys out, the run is paid for, even if you then quit the app. If a run fails, its credits are given back.
Your videos
Your footage and the videos you export are yours. We claim no rights to them, and they stay on your Mac.
You're responsible for having the right to use everything in your videos: your footage, the music and logos you add, and the people who appear. If someone makes a claim against us because of what's in your videos, or because you broke these terms, you'll cover what it costs us, including reasonable legal fees.
We don't keep copies of your footage, workouts or exports, so we can't get them back if they're lost. Keep your own backups.
The beeps and other sounds that come with SweatCut are ours. You can use them in any video you make with SweatCut, including videos you sell or earn money from.
The app
SweatCut, its design and its code belong to us. We let you install and use the app on Macs you use, under these terms.
SweatCut's name and logo are our trademarks. Don't use them without our written permission.
SweatCut downloads updates on its own and installs them when you quit, unless you switch that off in Settings › Updates. We may add, change or remove features over time.
If you send us ideas or feedback, we can use them without paying you or owing you anything.
What you can't do
Don't:
- share your account, or sell or give away access to SweatCut
- copy, change or take apart the app to get at its code, except where the law allows it
- get around SweatCut's limits, such as one free trial per Mac, the export count or credits
- overload or attack SweatCut Cloud, or reach it with anything other than the app
- use SweatCut to break the law or anyone else's rights
If you do, we can suspend or close your account.
If the police or a court asks us who used SweatCut, or how, we can cooperate with them. You give up any claim against us, and the people who work with us, over anything we do in an investigation, whether it's ours or the authorities'.
What we don't promise
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, YOU UNDERSTAND AND AGREE THAT YOUR USE OF SWEATCUT, ITS CONTENT, AND ANY SERVICES OR ITEMS FOUND OR ATTAINED THROUGH SWEATCUT IS AT YOUR OWN RISK. SWEATCUT, ITS CONTENT, AND ANY SERVICES OR ITEMS FOUND OR ATTAINED THROUGH SWEATCUT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR USE OF SWEATCUT AND YOUR COMPUTER, INTERNET, AND DATA SECURITY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY ANY TECHNOLOGICALLY HARMFUL ATTACK OR MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF SWEATCUT OR ITEMS FOUND OR ATTAINED THROUGH SWEATCUT OR ON ANY WEBSITES LINKED TO IT. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SweatCut and sweatcut.com link to other sites, and include content from other people. We don't control them and aren't responsible for them, so use them at your own risk. We try to keep what we publish up to date, but we don't promise it's accurate, complete or current.
We're not responsible for failing to do something under these terms, or for doing it late, when the cause is outside our reasonable control.
If we're ever found responsible for a loss anyway, the most we'll pay is what you paid for SweatCut in the 3 months before it happened, or US$100, whichever is less. We're not responsible for indirect losses, such as lost income, lost sponsorships or lost files.
Some laws give you rights that these terms can't take away. Those rights still apply.
Law and disputes
If something goes wrong, email us first and we'll try to sort it out.
These terms are governed by the laws of the State of Wyoming, USA. A dispute about them can only be brought in the state or federal courts in Wyoming, wherever you live, and you give up any objection to those courts hearing it, including that they're the wrong place for it.
Other terms
These terms, with the Privacy Policy and the terms of any offer you take up, are the whole agreement between you and us about SweatCut. They replace anything either of us said or agreed before.
If a court decides part of these terms can't be enforced, the rest still applies.
If we don't enforce part of these terms straight away, we can still enforce it later.
These terms don't make you and us partners, and don't make either of us the other's agent or employee.
You can't transfer these terms to anyone else without our written agreement.
We may transfer these terms to another company, for example if SweatCut is sold. Your rights under them stay the same.
Changes to these terms
When we change these terms, we'll post the new ones here and update the date at the top, so check back from time to time. A change applies as soon as it's posted, unless we say otherwise. Using SweatCut after a change means you accept it.
